Camera Recycle – Terms of Service

Welcome to Camera Resale (Formerly Camera Recycle) (the “Site”), which operates on Shopify’s e-commerce platform. We provide vintage cameras and photographic equipment for sale through our website, and we also purchase photographic items from customers. By accessing or using the Site, you agree to be bound by these terms of service (the “Terms”). References to Camera Recycle and Camera Resale are interchangeable and are the same entity, 

Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

• In any way that violates any applicable law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
• To impersonate or attempt to impersonate us, our employees, another user, or any other person or entity.
• In any way that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Site.
• To create and sell replicas or copies of any items purchased from the Site.

Intellectual Property

All content included on the Site, such as text, graphics, logos, images, and software, is our property or the property of our content suppliers and protected by United Kingdom and international copyright laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

Orders and Payments

By placing an order through the Site, you represent that you are at least 18 years old and legally capable of entering into binding contracts. You agree to pay all charges for your orders, including shipping and handling charges, and any applicable taxes.

We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, per household, or per order, and reserve the right to refuse or cancel any order that we believe, in our sole discretion, may violate these Terms.

Selling Cameras or Equipment to Us

a. Trade-In and Valuation Process

When you use Camera Recycle to sell or trade in equipment, any valuation or quote provided by us is provisional and subject to inspection and testing of the item once received. Payment will only be made after we have received, inspected, and accepted the item in the condition agreed.

b. Ownership and Risk

Ownership of your equipment remains with you until: (1) we have physically received the item, (2) completed inspection, and (3) confirmed acceptance and payment. Until those steps are completed, no binding contract of sale exists.

c. Proof of Ownership

We may request proof of identity and/or proof of ownership before completing any purchase. Camera Recycle reserves the right to decline to buy or return any item if we have reason to believe it may not lawfully belong to the seller or may be subject to third-party ownership.

d. Condition and Misrepresentation

If the item received differs materially from the description provided, is damaged, incomplete, or otherwise misrepresented, we may: (i) revise our offer, (ii) return the item at your cost, or (iii) dispose of the item if unclaimed after 30 days from notification.

e. Shipping Labels and Transit Liability

• If you use a postage or courier label provided by Camera Recycle, you are responsible for securely packaging the item and obtaining a proof of postage receipt when dropping it off.
• Once the parcel is scanned and accepted by the carrier, Camera Recycle becomes the contracting party with the courier and will manage any loss or damage claims.
• Payment will only be made once the parcel is delivered and inspected.
• If the parcel is lost in transit, Camera Recycle will investigate with the carrier and, if compensation is paid, may reimburse you up to the insured amount at its discretion.
• We are not obliged to make any payment until the investigation is complete and liability is confirmed by the carrier. If you choose to send items using your own courier or postage, risk remains with you until the goods are delivered to Camera Recycle.

f. Payment Timeframe

Payments for items we buy are typically made via bank transfer or PayPal within 2–3 business days after inspection and acceptance of your equipment. This timeframe may vary slightly during busy periods, but we will always communicate clearly if delays occur.

g. Fraud and Misrepresentation

We reserve the right to withhold payment or return goods if any item sent to us is not as described, counterfeit, damaged, or otherwise misrepresented. Any suspected fraudulent activity may be reported to law enforcement.

Refunds and Returns

Our refund policy is outlined separately on our website, and you agree to be bound by its terms. You are responsible for inspecting your purchased items upon receipt and notifying us of any defects or issues within a reasonable time frame.

VAT Notice: All items sold by Camera Recycle are sold under the UK VAT Margin Scheme. VAT is not reclaimable.

Disclaimer of Warranties

The Site and all information, content, materials, products, and services available on or through the Site are provided on an “as-is” and “as-available” basis, without any warranties of any kind, either express or implied.

Limitation of Liability

In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use or inability to use the Site or any products or services we offer, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Site or violation of these Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. You agree that any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these Terms

We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on the Site. Your continued use of the Site after the posting of any modifications constitutes your acceptance of those modifications.
